This document explains, in clear language, how our services work, what you can expect from us, and what we expect from you.
By using Smart Fast Hosting services, you agree to these terms.
You are responsible for your website, data, content, and backups
We provide hosting services, not legal, security, or compliance advice
We aim for reliable service, but outages can happen
Prices may change with at least 4 weeks notice
We do not tolerate illegal activity, abuse, or spam
Australian Consumer Law rights always apply
If something is unclear, please contact us before using the service.
Your account starts once payment is received and approved
You must provide a valid contact email and keep it up to date
The person or business that pays is the account owner
You are responsible for everything done using your account
We provide website hosting and related services on an “as available” basis.
We:
keep systems running and maintained
monitor for security and stability
provide support based on your plan
We do not:
manage your website content
guarantee compatibility with third-party software
guarantee data recovery unless explicitly stated
We aim to provide 98% availability per month for shared and reseller hosting.
If availability drops below this due to an issue within our control, you may request a service credit.
Credits are:
not automatic
not cash refunds
limited to future service credits
Availability does not include:
planned maintenance
customer misconfiguration
third-party services
cyberattacks or events outside our control
Backups are provided as a courtesy only
Weekly backups may overwrite older backups
Backups are not guaranteed to be complete or available
You are responsible for keeping your own backups at all times.
We are not responsible for lost, deleted, or corrupted data.
Services are billed in advance
Payments renew automatically unless cancelled
Late payments may result in suspension
We may change prices for existing or new services by giving at least 4 weeks notice via email, portal, or website notice.
If you do not agree, you may cancel before the change takes effect.
A 45-day money-back guarantee applies only to first-time shared or reseller hosting
Dedicated servers, domains, setup fees, and custom services are non-refundable
Breach of these terms removes refund eligibility
Refunds are processed in USD and may be affected by exchange rates.
Nothing in these terms excludes, restricts, or modifies any consumer rights you have under the Australian Consumer Law (ACL).
Under ACL, you may be entitled to remedies for:
major failures
services not provided with due care and skill
Where the law allows, our liability is limited to:
resupplying the services, or
paying the cost of having the services supplied again
To the maximum extent permitted by Australian law:
We are not liable for indirect or consequential loss
This includes loss of profits, data, business, or reputation
Our total liability for any claim is limited to the amount you paid for the affected service in the 30 days before the issue occurred.
We monitor systems for security, stability, and compliance
You must use strong passwords and protect your login details
If your account is compromised, you are responsible for activity under it
We may suspend services if security is at risk.
This policy explains what you must not do when using our services.
You must not use our services to host, store, distribute, or link to content or activity that is illegal, harmful, or abusive.
This includes, but is not limited to:
copyright or trademark infringement
pirated software or cracked licences
child exploitation material (zero tolerance)
promotion of illegal activity
malware, hacking tools, brute-force attacks
phishing, scams, or impersonation
unauthorised access to systems or networks
unsolicited bulk email
purchased or scraped mailing lists
mail bombers or mass messaging tools
excessive CPU, memory, disk, inode, or bandwidth usage
file sharing or mining software on shared plans
The following will result in immediate suspension or termination:
spam or blacklisting activity
child exploitation content
repeated abuse violations
fraud or deliberate harm
Serious violations may be reported to law enforcement.
We may:
suspend or terminate services without notice
remove or disable content
request information to verify compliance
Failure to respond to abuse notices within 48 hours may result in suspension.
We are not responsible for:
third-party software
plugins, themes, or integrations
services provided by other vendors
Use of third-party services is at your own risk.
We are not liable for service issues caused by events beyond our control, including:
natural disasters
power or internet outages
cyberattacks
government actions
These terms are governed by the laws of Queensland, Australia.
Any disputes will be handled in Queensland courts.
We may update these terms from time to time.
Continued use of our services means you accept the updated version.
